These Terms and Conditions ("Terms") govern your access to and use of www.gbho.org, www.hamrogbho.org, and all associated digital platforms and services (collectively, the "Platform") operated by the Global Bhutanese Hindu Organization ("GBHO," "we," "us," or "our"), as well as your participation in GBHO memberships, events, and programs. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Acceptance of Terms

These Terms apply to all visitors, users, members, donors, event participants, and others who access or use the Platform. By accessing the Platform, you represent that you are at least 18 years of age or are accessing the Platform under the supervision of a parent or guardian.

2. Changes to Terms

GBHO reserves the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of significant changes by updating the Effective Date at the top of these Terms. Your continued use of the Platform after any changes constitutes acceptance of those changes.

3. Permitted Use

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Platform in any way that violates applicable federal, state, local, or international laws or regulations

• Transmit any unsolicited or unauthorized advertising, promotional material, or spam

• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform

• Attempt to gain unauthorized access to any portion of the Platform or any connected systems

• Use any automated means, including bots, scrapers, or spiders, to access the Platform

• Impersonate GBHO, its officers, employees, volunteers, or any other person or entity

• Post or transmit content that is defamatory, obscene, fraudulent, or otherwise objectionable

• Collect or harvest personal information of other users without consent

4. SMS Terms of Service

By opting in to GBHO text messages — by checking the SMS consent box on our membership registration form or by texting START to our number — you agree to receive recurring text messages from the Global Bhutanese Hindu Organization, including event notifications, program announcements, ceremony reminders, and membership or account alerts.

• You can cancel at any time by replying STOP. After you send STOP, we will send a final message confirming you have been unsubscribed. No further messages will be sent unless you opt in again.

• Consent to receive text messages is not a condition of membership or of any purchase or service.

• Carriers are not liable for delayed or undelivered messages.

5. Intellectual Property

The Platform and its entire contents, features, and functionality — including text, graphics, logos, icons, images, audio and video clips, digital downloads, data compilations, and software — are the exclusive property of GBHO or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Platform without prior written consent from GBHO.

6. User-Generated Content

By submitting, posting, or uploading any content to the Platform ("User Content"), you grant GBHO a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.

7. Photo and Video License Grant

By attending any GBHO event, program, or activity, or by submitting photographs or videos to GBHO, you grant GBHO a perpetual, royalty-free, worldwide license to use, reproduce, display, distribute, and create derivative works from such images and recordings for any lawful organizational purpose, including marketing, education, fundraising, and social media. If you do not wish to be photographed or recorded, you must notify GBHO staff in writing prior to the event.

8. Account Registration

Some features of the Platform may require registration. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify GBHO immediately of any unauthorized use of your account. GBHO shall not be liable for any loss resulting from unauthorized use of your account.

9. Membership

GBHO offers multiple membership categories (including Free, General Yearly Family, Lifetime, Honorary, Corporate, Senior, Single, Differently Abled, Founding, Co-Founding, Gold, Silver, and Platinum). Specific benefits, fees, and eligibility for each type are published on the Platform and may be updated with reasonable notice. Membership fees, where applicable, are due at application or renewal and are non-refundable except as provided in the Refund and Cancellation Policy (Section 13). Members are expected to conduct themselves consistently with GBHO's values; GBHO may suspend or revoke membership for violations of these Terms, the GBHO Code of Conduct, or applicable law. Membership does not constitute an ownership interest in GBHO. Either party may terminate membership at any time; requests may be sent to contactus@hamrogbho.org.

10. Events and Programs

Registration for GBHO events and programs may be conducted online, in person, or via other methods specified by GBHO, and is complete only upon receipt of any applicable fee and confirmation from GBHO. GBHO reserves the right to limit attendance, establish eligibility criteria, and accept or decline any registration. GBHO may modify, postpone, or cancel any event due to insufficient enrollment, weather, public health concerns, or other circumstances; in the event of cancellation by GBHO, registrants will be offered a refund or credit per Section 13. Participants are expected to behave respectfully, follow instructions from GBHO staff, and respect the religious and cultural nature of GBHO gatherings. GBHO reserves the right to remove any participant for disruptive, unsafe, or inappropriate behavior without refund. Programs and events involving minors (under 18) require written parental or guardian consent and completion of applicable waiver forms.

11. Assumption of Risk, Release, and Waiver of Liability

Participation in GBHO activities, events, and programs, and use of the Om Center Divya Dham property at 4270 State Route 309, Galion, OH 44833, may involve inherent risks, including physical activity, outdoor environments, and ceremonial activities. By participating or accessing the property, you voluntarily assume all such risks and, to the fullest extent permitted by law, release, waive, and discharge GBHO, its officers, directors, employees, volunteers, agents, members, successors, and assigns from any and all claims arising out of or relating to your participation or presence, and agree to indemnify and hold them harmless from claims arising out of your participation, your use of the property, or your breach of these Terms. All persons on the property must follow posted rules and instructions from GBHO staff and respect the sacred and spiritual nature of the property.

12. Donations

GBHO is a 501(c)(3) tax-exempt organization (EIN 82-2341423). Donations are tax-deductible to the extent allowed by law. GBHO will provide written acknowledgment of donations as required by IRS regulations. Donors may designate gifts for specific purposes; if a designated purpose becomes impracticable, GBHO may redirect the gift to the most closely related purpose. Donations are generally non-refundable; GBHO may issue a refund at its sole discretion in the case of a processing or donor error within 30 days of the donation. Voluntary dakshina offerings made in connection with religious programs constitute charitable gifts to GBHO.

13. Refund and Cancellation Policy

Membership fees are non-refundable once processed, except in the case of a billing error or where required by law. Unless otherwise stated in event-specific materials, the following schedule applies to event registration fees:

• 30+ days before event: full refund minus processing fee

• 8–29 days before event: 50% refund

• 4–7 days before event: 25% refund

• Less than 72 hours before event, or no-show: no refund

Property rental and event hosting cancellation terms are specified in the applicable Rental or Event Hosting Agreement. If GBHO cancels an event, program, or rental due to circumstances within its control, affected participants will receive a full refund; if GBHO cancels due to force majeure, GBHO will offer a credit or partial refund at its discretion. Approved refunds are processed within 14 business days using the original payment method; third-party processing fees may be deducted.

14. Disclaimer and Limitation of Liability

The information on the Platform is provided for general informational and community purposes only and does not constitute legal, financial, medical, tax, or other professional advice. GBHO makes no warranties or representations, express or implied, as to the accuracy, completeness, suitability, or availability of any information on the Platform, and does not warrant that the Platform will be uninterrupted or error-free. To the fullest extent permitted by law, GBHO, its officers, directors, employees, volunteers, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or any content thereon. The Platform may contain links to third-party websites; GBHO does not endorse and is not responsible for their content or practices.

15. Dispute Resolution, Arbitration, and Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law rules. Before initiating any formal proceeding, you agree to contact GBHO in writing at contactus@hamrogbho.org with a description of the dispute; GBHO will use reasonable efforts to address it within 30 days. If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, taking place in Crawford County, Ohio, or via videoconference by agreement, except that either party may seek injunctive relief in court to protect intellectual property rights or prevent irreparable harm. ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. TO THE FULLEST EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THEIR RIGHTS TO A TRIAL BY JURY. Any claim must be commenced within one (1) year after the cause of action accrues. For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Crawford County, Ohio.

16. Miscellaneous

These Terms, together with any applicable Membership Agreement, Event Registration confirmation, Rental Agreement, or Event Hosting Agreement, constitute the entire agreement between you and GBHO regarding their subject matter. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. GBHO's failure to enforce any provision is not a waiver of it. You may not assign these Terms without GBHO's prior written consent; GBHO may freely assign its rights and obligations. GBHO shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control. These Terms are written in English; the English version controls over any translation.
